Terms of Service

These Terms of Service govern your use of Harvest. Harvest helps real estate professionals organize farms, contacts, scripts, follow-ups, campaigns, team workflows, and related outreach activity. Harvest is not a law firm, brokerage, MLS, compliance service, or consumer reporting agency. By creating an account or using Harvest, you agree to these Terms.

Eligibility

Harvest is intended for licensed real estate agents, brokers, brokerage teams, and authorized real estate staff. By using Harvest, you represent that you are legally allowed to use the service for real estate prospecting in your jurisdiction and under your brokerage policies. You must be at least 18 years old and able to enter into a binding agreement.

Accounts and profile information

You are responsible for keeping your account secure and for all activity under your account. You must provide accurate and current registration, profile, and business information, including your name, brokerage, email, phone number, and business or brokerage mailing address where required for campaign or advertising compliance. If Harvest collects license number, licensed jurisdiction, team, brokerage, or signature information, you must keep it accurate.

Harvest may use this information in scripts, messages, emails, campaign footers, signatures, account notices, compliance disclosures, and team workflows. Contact joe@harvest-app.net if you suspect unauthorized access or need account help.

Your responsibility for compliance

Harvest provides tools and draft assistance. It does not provide legal advice, does not guarantee compliance, and does not replace your brokerage, attorney, MLS, or compliance review process.

You are responsible for complying with all laws, rules, agreements, and policies that apply to your use of Harvest and your outreach, including the Telephone Consumer Protection Act (TCPA), FCC rules, FTC Telemarketing Sales Rule, National Do Not Call Registry, state do-not-call and telemarketing laws, CAN-SPAM, CASL if contacting Canada, fair housing and anti-discrimination laws, real estate licensing and advertising rules, MLS/listing-data rules, brokerage policies, privacy and data-protection laws, and all opt-out or do-not-contact requests.

Acceptable use

You may use Harvest only for lawful real estate business purposes. You may not use Harvest to harass, deceive, discriminate, spam, scrape data unlawfully, violate privacy rights, violate brokerage or MLS rules, send unlawful communications, resell or misuse data, interfere with the service, attempt to bypass security controls, reverse engineer the service except as permitted by law, or use Harvest in a way that could harm Harvest, users, homeowners, recipients, or the public.

You may not upload or use data unless you have the rights and authority needed to use it in Harvest and to contact the relevant people where applicable.

Calls and texts

Harvest may prepare scripts, notes, call prompts, text drafts, and follow-up suggestions. Where applicable, Harvest may open the native iPhone Phone or Messages app with information you choose to use. You initiate calls and texts; Harvest does not authorize unlawful robocalls, autodialing, power dialing, ringless voicemail, AI voice calls, prerecorded messages, bulk SMS, automated cold SMS, or any other outreach that violates applicable law.

You are responsible for confirming consent where required, identifying yourself and your brokerage or business where required, calling or texting only during permitted hours, honoring do-not-call and do-not-contact requests, and keeping your own suppression lists current.

Email campaigns and exports

Harvest may help prepare email drafts, campaign copy, recipient exports, sender details, and follow-up records. Campaign emails may be commercial marketing messages. You are responsible for truthful sender identity, accurate subject lines, required disclosures, physical mailing address where required, unsubscribe mechanisms, and honoring unsubscribe or opt-out requests.

You may not email suppressed, unsubscribed, or do-not-contact recipients through Harvest or through exported lists. If you export emails or contact data, you are responsible for using that data only in lawful systems and for preserving suppression and unsubscribe obligations outside Harvest.

Third-party property and contact data

Harvest uses third-party property and contact data. Estimated values, equity signals, ownership details, and contact information may be incomplete, inaccurate, outdated, or misattributed. You agree to verify important information before quoting it, sharing it, contacting someone, or making business decisions.

Skip-trace, property, homeowner, and contact data may be inaccurate, stale, incomplete, or misattributed. Phone numbers, emails, mailing addresses, ownership signals, DNC/suppression flags, and property details may not be correct. You must verify important information before relying on it, quoting it, sharing it, or contacting someone.

Contact and property data may be used only for lawful real estate prospecting and related business workflows. You may not resell, redistribute, publish, scrape, warehouse for unrelated purposes, or misuse Harvest-provided contact data. You may not use Harvest or Harvest-provided data for FCRA-regulated eligibility decisions or similar purposes, including tenant screening, credit, lending, insurance, employment, housing eligibility, or any other consumer eligibility decision.

AI-generated content

Harvest may use third-party AI models to draft or assist with scripts, texts, emails, campaign copy, summaries, briefings, follow-ups, and related content. AI output is draft assistance only. It may be wrong, incomplete, outdated, biased, noncompliant, or unsuitable for a recipient, property, brokerage, or jurisdiction.

You must review and approve AI output before using it. You are responsible for all claims, offers, statements, advertising content, fair housing compliance, brokerage approval, legal compliance, and factual accuracy in anything you send, say, export, publish, or rely on. Do not rely on AI output for legal, financial, valuation, licensing, compliance, or other professional advice.

Fair housing and non-discrimination

You may not use Harvest to discriminate, steer, exclude, target, harass, or make housing-related decisions based on protected characteristics under federal, state, or local law. Do not use protected-class language, neighborhood characterizations tied to protected classes, predatory claims, misleading pressure, or outreach that could violate fair housing or anti-discrimination laws.

You are responsible for reviewing targeting, scripts, messages, campaign copy, AI output, and follow-up workflows for fair housing and brokerage compliance before use.

MLS, listing, brokerage, and advertising rules

Harvest is not an MLS and does not grant rights to use listing data. If you enter, upload, paste, summarize, or rely on listing, MLS, brokerage, or third-party property data in Harvest, you are responsible for confirming that you have permission to use it and for complying with all display, storage, attribution, advertising, retention, and deletion rules.

You are responsible for required advertising disclosures, brokerage approvals, license disclosures, team-name rules, state-specific advertising rules, and any local real estate regulations that apply to your communications.

Subscriptions, App Store purchases, and refunds

Consumer iOS subscriptions and credit purchases are managed through the Apple App Store unless Harvest provides a separate enterprise or internal arrangement in writing. Prices, billing intervals, renewal terms, and trial terms appear in Apple's purchase sheet at checkout. Subscriptions renew unless cancelled according to Apple's rules. You can manage or cancel App Store subscriptions in iOS Settings under your Apple ID.

Refund requests for App Store purchases are handled by Apple under Apple's policies. Harvest cannot directly refund App Store purchases unless Apple or applicable law provides a process that allows it. Prepared demo workspaces, sales-led invites, owner support actions, or internal review states do not by themselves activate a paid App Store subscription.

Your content

You retain ownership of content you submit to Harvest, such as profile information, listings, farms, notes, contacts you upload, campaign drafts, templates, and related materials. You grant Harvest a limited, worldwide, non-exclusive license to host, process, display, transmit, and use that content as needed to provide, secure, support, and improve the service.

You represent that you have all rights and permissions needed for the content and data you submit, including any rights needed to use listing, property, contact, brokerage, brand, image, or campaign materials in Harvest.

Privacy

Harvest handles personal information as described in the Harvest Privacy Policy. By using Harvest, you agree that Harvest may process information as described there. If you use Harvest on behalf of a team, brokerage, or organization, you are responsible for making any notices, consents, and agreements required for your contacts, team members, and data sources.

Suspension and termination

You may stop using Harvest or delete your account where the app provides deletion tools. Harvest may suspend or terminate access, remove content, restrict features, or refuse service if we believe your use creates legal, security, compliance, deliverability, platform, support, or abuse risk.

Reasons may include ignored opt-outs, unlawful outreach, high complaint rates, DNC misuse, spam, harassment, fair-housing risk, discriminatory targeting, misleading claims, data misuse, scraping, resale or redistribution of contact data, MLS/listing-data misuse, payment issues, security concerns, legal requests, brokerage complaints, or violations of these Terms.

Disclaimers

Harvest is provided "as is" and "as available." To the fullest extent permitted by law, Harvest disclaims warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and error-free operation.

Harvest does not guarantee leads, appointments, listings, conversions, revenue, deliverability, contact-data accuracy, valuation accuracy, legal compliance, or that any particular outreach action is permitted in your jurisdiction. Estimates are not appraisals or guaranteed valuations.

Limitation of liability

To the fullest extent permitted by law, Harvest will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, business opportunity, revenue, or anticipated savings. To the fullest extent permitted by law, Harvest's total liability for claims relating to the service is limited to the amount you paid Harvest, if any, in the 12 months before the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold Harvest harmless from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your content, data, outreach, exports, use of Harvest, violation of these Terms, violation of law, violation of third-party rights, or misuse of property/contact data.

This includes claims related to TCPA, FCC rules, FTC Telemarketing Sales Rule, National or state DNC laws, CAN-SPAM, CASL, state telemarketing rules, fair housing, licensing or advertising violations, MLS/listing-data misuse, brokerage-policy violations, privacy or data-protection claims, skip-trace/contact-data misuse, unlawful export/resale/redistribution of data, and messages or calls sent using or based on Harvest output.

DMCA and copyright complaints

If you believe content in Harvest infringes your copyright, send a notice to joe@harvest-app.net that includes: a description of the copyrighted work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is not authorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature. Counter-notices may be sent to the same address.

Apple App Store terms

These Terms are between you and Harvest, not Apple. Apple is not responsible for Harvest or its content and has no obligation to provide maintenance or support for Harvest. To the extent permitted by law, Apple has no warranty obligation for Harvest. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you. You represent that you are not located in a U.S.-embargoed country and are not on a U.S. government prohibited or restricted-party list.

Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, excluding conflict-of-law rules, except where applicable law requires otherwise. Before filing a claim, you agree to contact joe@harvest-app.net and try to resolve the dispute informally for at least 30 days. If the dispute is not resolved, claims will be brought in the state or federal courts located in New Jersey, unless applicable law requires a different forum.

Changes to these Terms

Harvest may update these Terms from time to time. If we make material changes, we will provide notice in the app, by email, or by another reasonable method. Continued use of Harvest after the updated Terms become effective means you accept the updated Terms.

Miscellaneous

If any provision of these Terms is unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any applicable purchase terms, are the entire agreement between you and Harvest for the service. You may not assign these Terms without our consent. Harvest may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
